WhoWouldAIHire Terms of Service

Who we are

These Terms of Service ("Terms") govern your use of whowouldaihire.com and the services offered under the WhoWouldAIHire name (the "Services"). Robert Companies LLC provides the Services. It is a [state of organization: PENDING] limited liability company ("we," "us," "our").

By using the Services or making a purchase, you agree to these Terms. If you use the Services for a business, you confirm you have authority to bind that business.

1. What we provide

Free AI Visibility Report (the "Report"). We ask AI assistants the questions your customers ask, several times each. We show:
how often your business is named;
who is named instead;
which sources the assistants cited;
a prioritized list of fixes.
AI Visibility Fix (the "Fix"). A one-time service. We do the following:
write and publish up to 5 service pages and an FAQ page;
fix schema and AI-crawler access;
optimize your Google Business Profile;
submit directory listings;
set up a review-request campaign;
pitch you to local best-of lists.

We then re-measure at day 30, 60 and 90. - AI Visibility Growth ("Growth"). A monthly subscription that covers: - ongoing re-measurement; - new pages; - review requests; - listings; - outreach. - Leaderboards. Free public pages showing which businesses AI assistants named for a city and trade.

2. How results are measured, and what we don't promise

We ask AI assistants customer-style questions through their official programming interfaces, usually with web search on. We record which businesses are named and which sources are cited.
AI answers change from run to run and over time. Results may differ from what a person sees in a consumer app, which can be personalized or location-specific. A Report is a snapshot taken at a stated time with a stated method.
No guarantee of rankings or results. We don't control any AI assistant. We don't promise that our work will make any assistant recommend your business, or that it will produce any amount of leads or revenue.
Our guarantee is about our work. Fix deliverables are completed within 14 days of setup, or you get a full refund. The Refund Policy has the details.
AI assistants can make inaccurate statements. We report what they said; we don't endorse it as true. Our recommendations are general information, not legal, financial or professional advice.

3. Access, authorization and your content (Fix and Growth)

Access

We never ask for your passwords. You give us access by:
adding us as a manager (not owner) on your Google Business Profile;
adding us as a user on your website, or by naming the person who manages it.
You can remove our access at any time. Work that needs that access will stop.

What you authorize us to do

You authorize us, on your business's behalf, to: - edit your Google Business Profile; - publish pages and technical changes on your website; - create and update directory listings in your business's name; - send review requests to customers you provide; - contact list editors about your business.

What you confirm

Business information. It's accurate, and you'll tell us when it changes.
Customer contacts. You collected the customer contact details you give us lawfully, and you may use them for review requests. We ask every customer you give us, not only happy ones. We never offer incentives tied to positive reviews, and we never write reviews (16 CFR Part 465).
Text messages. We only text customers where the law allows.

Content we create

Content we write for your business is yours once you've paid for it.
We may keep anonymized data and our own methods.
With your permission, we may share before-and-after results.

4. Clara, our AI assistant

Onboarding and support are handled by Clara, an AI assistant. Clara is labeled "AI assistant" wherever she appears. If you ask, she'll tell you she isn't human.
You can ask for a human at any time. Clara never asks for passwords.
Chat transcripts are kept as described in our Privacy Policy.

5. Text messages (if you opt in)

If you agree to texts, we text you only about your setup, such as verification codes and quick approvals. We don't send marketing texts.
Message and data rates may apply. Reply STOP to opt out, or HELP for help.
Agreeing to texts is not a condition of purchase.

6. Purchases, subscriptions and billing

Prices are in U.S. dollars and shown at checkout. Stripe processes payments; we never store full card numbers. Taxes may be added where required.
3-payment plan: 3 monthly charges of $179. The plan ends automatically after the third payment.
Growth renews automatically every month until you cancel. You can cancel anytime with the link in your receipt email or by emailing [support email: PENDING]. Cancellation takes effect at the end of the current billing period.
Fix + Growth bundle: Growth starts with a 30-day free trial. Unless you cancel before the trial ends, Growth then renews at $199/month.
Refunds follow our Refund Policy, which is part of these Terms.

7. Leaderboards and businesses named on them

Leaderboards rank businesses by how often AI assistants named them in answer to our questions.
Rankings are never sold. Buying a Fix or Growth doesn't change any business's ranking on our pages.
Believe something is inaccurate, or want your business removed? Email [support email: PENDING] with the page URL and we'll review it promptly.
Business names and trademarks belong to their owners. WhoWouldAIHire isn't affiliated with, endorsed by, or sponsored by OpenAI, Google, Anthropic, xAI, or any business named on our pages.

8. Your responsibilities

Accurate information. You agree to provide accurate information.

You agree not to: - use the Services to harass, defame or mislead anyone; - scrape, overload or interfere with the Services; - use Reports or Leaderboards in advertising in a way that implies an AI company or WhoWouldAIHire endorses you.

You may share your own Report, and truthfully quote your Leaderboard position with a link and the date.

9. Intellectual property

We own the Services, our methods, the Leaderboard pages, and the format of Reports.
You get a non-exclusive, perpetual license to use your Report for your business.
Content we create for you under the Fix or Growth is covered in Section 3.

10. Communications

We send transactional messages such as receipts, Reports and setup steps.
Any marketing email identifies us, includes our postal address ([mailing address: PENDING]), and has a working unsubscribe link. We honor opt-outs within 10 business days.

11. Disclaimers

EXCEPT FOR THE WORK GUARANTEE IN OUR REFUND POLICY, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY AI ASSISTANT WILL RECOMMEND ANY BUSINESS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROBERT COMPANIES LLC AND ITS MEMBERS, MANAGERS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, LEADS OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Changes and termination

We may update these Terms by posting a new version with a new effective date.
We'll email active subscribers about material changes at least 14 days in advance.
We may suspend service for violations of these Terms. You may stop using the Services at any time.

14. Governing law

These Terms are governed by the laws of [state of organization: PENDING], without regard to conflict-of-law rules.
